Agreements
There can be various types of agreements between parties within family law. Agreements are voluntary and usually reflect what has been agreed through discussion and negotiation between the couple and their solicitors. Any two people can enter into an agreement. It is a contract between them agreeing what will happen in the future. Sometimes these agreements will be final, other times they can be changed later by agreement or if certain things change. Agreements have legal implications and we think that it is important to have legal advice before you sign any agreement.
These are some of the most common types of agreement:
Separation agreements
Separation agreements set out what will happen with money, houses, debts and other issues arising from a couple separating. These agreements are made by couples who separate whether they are married or whether they have been cohabiting / living together.
Child Agreements
Child agreements set out arrangements for children upon separation of parents, usually where the children will live, what time they will spend with each parent and financial support. Sometimes these arrangements are included in separation agreements.
Pre Nuptial Agreements
Pre-nuptial agreements are made by a couple before they marry to agree what will happen to their assets or debts if they should separate in the future.
Cohabitation agreements
Cohabitation agreements are agreements between a couple who live together without being married and agree what will happen in the future if the couple separate.
