Guardianship & Powers of Attorney
When an individual is unable to attend to their own affairs through incapacity or ill health, a third party – often a family member or friend – can apply to the Court for a Guardianship order, to take all necessary decisions on that individual’s behalf. The procedure is not straightforward, and requires that a number of different medical and mental health reports are obtained.
A Power of Attorney is a document drawn up for an individual, appointing a third party to make decisions on their behalf, if and when that individual becomes unable to do so themselves.
